Captive Domicile Summary

Iowa officially entered the captive insurance market with the passage of legislation in 2023, becoming the 36th US jurisdiction to authorize captive insurance companies.

The law, Senate File 549, which took effect on July 1, 2023, allows for the formation of several types of captives, including pure captives, industrial insured captives, captive risk retention groups, branch captives, protected cell captives, and special purpose captives. Minimum capital and surplus requirements were established—$250,000 for pure captives and $500,000 for industrial insured and protected cell captives—along with a premium tax framework designed to be competitive with other domiciles. Governance requirements include holding an annual meeting in Iowa and appointing at least one director or manager who is a resident of the state.

Regulators within the Iowa Insurance Division have moved quickly to build out a dedicated captive insurance bureau, including specialized staff to oversee licensing and regulation. Captive risk retention groups must undergo financial examinations at least once every 3 years, while all other captive types are subject to examination as deemed appropriate by the Division. Captives must file annual reports by April 1 and undergo examinations at least once every 3 years, further aligning Iowa's regulatory framework with best practices in the industry.
