Opting Out of Workers Compensation

Workers Comp
July 29, 2016

The International Association of Industrial Accident Boards and Commissions (IAIABC) issued a report in May 2016 that compares the benefits and coverage of the workers compensation opt-out alternative adopted by Oklahoma with the traditional compulsory workers compensation coverage required in most states. Those not familiar with opt out should know that it gives employers a choice to purchase a workers compensation policy or to develop an employer benefit plan to cover occupational injuries and illnesses.

The Understanding the Opt-Out Alternative report (registration required) will provide readers a better understanding of what is likely to be a continuing policy debate in some state legislatures. The report focuses on five key areas.

  • Benefits and coverage and how they compare to each other

  • Processing any claims that are disputed

  • How the Employee Retirement Income Security Act of 1974 relates to workers compensation

  • Regulating employers that opt out of workers compensation

  • Any other issues that affect insurance and safety

The IAIABC report is fact based and worthy of your review. It will be an agenda topic of discussion at the upcoming summer meeting of the National Association of Insurance Commissioners.
