Legislative Update: August 31, 2011 - The Self-Insurance Institute of America, Inc. (SIIA) today submitted a letter to Michigan Governor Rick Snyder formally requesting him to veto legislation that would impose a one percent tax on medical claims paid by health plans, including self-insured group health plans. SIIA's letter cites the fact that the proposed law likely violates ERISA preemption as the reason for the veto request. Member can access the full text of the letter on-line at www.siia.org. According to local sources, Governor Snyder is supportive of the legislation as part of a broader state budget reform initiative. Should the legislation be signed into law, SIIA expects to explore litigation response options. "While our attention has been largely focused at the federal level for obvious reasons, we also have to be directly engaged at the state level as circumstances arise," said SIIA Chief Operating Officer Mike Ferguson. "More specifically, any state action that compromises ERISA preemption deserves our serious attention and response."
