Reservation
of Rights Letters, Disclaimer Letters, Non-Waiver Agreements.
This inaugural edition identifies the law in each of the 50 states
to the extent it exists regarding the timing and content of reservation
of rights letters, disclaimer letters, and non-waiver agreements.
In the past several years, the insurance industry
has experienced an unprecedented number of claims in which individuals
and entities alike have sought coverage for a wide variety of claims
under a broad universe of insurance policies. This avalanche of
claims places a significant burden on those insurance claim professionals
responsibile for analyzing the claims, determining whether coverage
should be afforded, and responding to the insured or purported insured
in a timely and effective manner to protect the interests of the
insurance company. It is imperative that claims professionals be
aware of the requirements of the states in which they are working
with regard to the timing and content of these notifications.

Captive
Insurance Corporate Secretary and Corporate Governance Newsletter,
Volume One, Number 1, June 2007 |
John J. O'Brien, JD, CLU, CPCU.
This first issue supplies two useful checklists:
- The first checklist is suggested for a corporate secretary to
follow in the organizational Board of Directors meeting of a Risk
Retention Group or Captive.
- The second is an audit committee checklist where John opines
that the items set forth there are also a good checklist for boards
of directors of captives and RRGs, even when an audit committee
is not required.
